UK has opened a new era of immigration, and the new category of visa is officially launched!On March

On March 15, local time, the British Home Office suddenly released heavy information, updating and releasing the Immigration Law Amendment Notice "Statement of Changes to the Immigration Rules: HC 1118".



The following summarizes the main changes:


I. Establish a large visa category


The Global Business Mobility is a new visa model created for overseas companies who need to establish overseas institutions and transfer employees. The specific information is as follows:


minimum wage requirement


Senior and professional employees: The minimum wage is the lower of the £42,400 annual income and the industry average wage.


Expanding employees in the UK: The minimum wage is based on the lower of the annual income of £42,400 and the average salary in the industry.


Graduate Internship Visa: The minimum wage is the one with 23,100 income and 70% of the average salary in the industry as the minimum threshold.


Residence and transfer to permanent residence


All visas under this category are not transferred to permanent residence, which means that the applicant must leave the country immediately after the visa expires, and the cumulative residence time in any six years shall not exceed five years (the maximum residence time for high-income applicants is ten years). Cumulative residency during the year does not exceed nine years).



Other mandatory conditions


Applicants must have worked for the employer for more than 12 consecutive months at the time of application (3 months for graduate interns)


5 major categories


1. Senior and professional employees

This type of alternative can replace the current employee transfer system of multinational companies, where overseas companies can send senior or professional employees to work in the UK.


2. Graduate Internship Visa

The Graduate Internship visa type can also use the MNC Intern Conversion System to work in overseas companies.


3. Expansion of employees in the UK

This type of visa will replace the previous Overseas Representative Office visa, where senior and professional employees from overseas come to the UK to work for overseas companies.


Compared with the original visa, there are several changes:

The overseas chief is only applicable to the top responsible person to apply, and the new visa category can send multiple employees to apply at one time.

Although the terms of transferring to permanent residence have certain vagueness and uncertainty, the Shanghai Overseas Chief does have a channel to transfer to permanent residence from the legal channel, while the new visa category does not have this channel, which means that this category of visa cannot be directly transferred to permanent residence.


This type of visa corresponds to a salary threshold of £42,400 and a category with a high average level of industry companies as the minimum salary threshold.


4. Service Providers

This type of visa is suitable for being employed by an overseas service provider or as an experienced overseas self-employed person, where a visa is granted when an international trade association in the UK has been assigned a task.


5. Seconded employees

Types of visas for high-level employees in companies with overseas secondment needs.



II. Visa renewal for overseas representative offices


The Chief Business Representative visa will likely be replaced by a new visa 'UK Expansion Worker' category under the upcoming Global Business Route Mobility Route, which will not On to permanent residence.


There is no impact on the renewal, permanent residence, etc. of customers who have applied for approval. According to the Act, this policy will take effect on April 11, 2022, so in principle, applicants who have submitted before can still lock in the old policy.


3. Two new types of visas are added


In addition to The Global Business Mobility, Immigration has added two new categories of visas:


1. Introduction of High Potential Talents (HPI)


1. You can bring your family members to apply;

2. Inability to obtain permanent residence from this visa;

3. Age requirements: 18 years old or above;

4. When applying, it is necessary to prove that you have stayed in the UK (in the form of travel, study, work);

5. The application review standard is a point-based application: the score requirement is 70 points, including 3 conditions:

Undergraduate or postgraduate qualifications in the top 50 universities recognized by the Immigration Service (50 points for meeting the requirements);

Language requirements: CEFR B1 (10 points for meeting the requirements);

Funding requirements: £1,270 (to get 10 copies);

6. Visa duration: There are two types of visas, 2-year visa validity for undergraduate or postgraduate certificates and 3-year visa validity for doctoral certificates;

7. The certificate used in the application needs to be certified by Ecctis.


2. Value-added Enterprise Visa

Applicants need to get a job in a Scale-UP company in the UK, which is similar to the Skilled Worker visa and requires a UK business to be eligible for the Scale-Up visa. If the company is to register as a Sponsor of this type of visa, it needs to have at least an annual increase in turnover or employee numbers of more than 20% in the past 3 years, and the company needs to have at least 10 employees at least 3 years ago;


The job requirements must be Graduate Level, RQF Level 6, with an annual salary of at least 33,000,00 Pound or a higher salary according to the job requirements;


The applicant will first obtain a 2-year visa. If the salary is above 33,000.00 Pound for at least 1 year of working in the company for 2 years, then the visa will be renewed for another 3 years;


In the 3 years after the renewal, the applicant needs to have a salary of at least 33,000.00 Pound for at least 2 years;


After meeting the above requirements, after 5 years, the applicant will have the opportunity to apply for permanent residence;


After the applicant gets a job at Sponsored and has worked for 6 months, there will be an opportunity to change jobs to another company.


Before the emergency shutdown of British investment immigration, the Immigration Bureau also suggested that everyone apply for more innovative visas, and this policy change has made the UK's desire for top talents more clear, and growth-oriented enterprises are also highly valued by the Immigration Bureau.


At present, except for the innovation visa, other visas in the UK take 5 years to transfer to permanent residence. The innovation visa has always been popular with investors who intend to immigrate to the UK due to its advantages such as low investment threshold, high pass rate, and the ability to apply for permanent residence in 3 years.
